Terms of Service
1. Scope, etc.
These terms of service apply to services provided by SoSafe International AB, organization number 559246-3862, via the mobile application SoSafe.
2. Contractual Obligation
To use SoSafe’s services, you must be over 18 years old and reside in Sweden.
All use of SoSafe is conditional on you, the User, accepting these Terms of Service, which you also confirm when you download the app and create a user account. To use the Service, an active subscription is also required. Your subscription is usually governed by additional terms specific to your subscription (“Subscription Terms”) which you accept when you register for the subscription.
You can stop using the service and terminate your subscription at any time. These terms apply if you, the User, have an active SoSafe account.
3. Services
SoSafe is a modern security service for individuals that makes it easy to call for help when you need it. The services offered by SoSafe are provided through the SoSafe app.
3.1. Emergency Contact Alerts
With the Emergency Contact Alert service, you can initiate an alert with a simple button press to call your loved ones when you are in an emergency. You add people as your Emergency Contacts in the SoSafe app by providing the person’s name and phone number, and you can remove or add new Emergency Contacts at any time. As a User, you are responsible for keeping your Emergency Contacts’ information up to date.
When you, as a User, designate a person as an Emergency Contact, SoSafe will contact the person to ensure they consent to being your Emergency Contact. Until SoSafe has received such consent, the person does not constitute an Emergency Contact.
Once the Emergency Contact has provided their consent, SoSafe will save the contact information to call the Emergency Contact in case you, the User, initiate an alert.
If you initiate an alert, SoSafe sends a text message to your Emergency Contacts with a link. Via the link, the Emergency Contacts have access to your GPS position and can also listen to real-time audio recordings from the location, via the phone’s microphone. The recording of sound and GPS position will continue until the alert event is concluded. The audio and GPS information is saved in the SoSafe app for up to 12 months after the alert event ends. As a User, you can choose to delete the entire alert history or remove your emergency contacts’ access to the saved information at any time.
3.2. Alarm Center and Guard Service
The Alarm Center and Guard Service involves contacting an alarm center if you, the User, initiate an alert. This service can only be provided in certain areas; current information about covered areas is available on SoSafe’s website. The alarm center is staffed 24/7. As a User, you can choose to call the alarm center according to option a) or b) below:
a) Direct Response Without Prior Communication.
Through the app and the SoSafe button, you, as a User, can instruct the alarm center to respond to your current GPS position without prior communication by pressing a button. If the User gives the alarm center such an instruction, the alarm center should respond as soon as reasonably possible to the User’s GPS position. At this GPS position, the alarm center will assess the situation and take appropriate action, which may involve contacting 112 (emergency services).
b) Consultation with the Customer and Potential Response.
Through the app and the SoSafe button, the Customer can, by pressing a button, contact the alarm center and instruct the alarm center to listen to the real-time audio recording from the User’s phone. The alarm center assesses the situation to decide in consultation with the User whether to respond to the User’s GPS position. If the alarm center cannot contact the User or if the User is unable to communicate for any reason, the alarm center will make an assessment and take appropriate action, which may involve contacting 112.
If the alarm center is instructed by the User not to respond, no action will be taken. In such a case, neither SoSafe nor the alarm center has any liability for the initiated alert.
If the alarm center contacts 112, 112 assumes responsibility for the alert. SoSafe and the alarm center are not responsible for the decisions made by 112. SoSafe or the alarm center does not guarantee that 112 will respond or act within a certain time frame.
SoSafe and the alarm center are not responsible for responding to the User’s GPS position if the GPS position displayed by the User’s phone is incorrect (e.g., because the User has turned off relevant functions or because the GPS is not working or providing incomplete or misleading information for another reason).
The cost of the alarm center’s response and any other services is specified in the subscription agreement.
If the alarm center contacts the police or other public emergency services to assist the User who initiated an alert and claims are directed against SoSafe or the alarm center as a result, the User is obliged to compensate SoSafe to the same extent.
3.3. Walkie-talkie – Two-way Communication During an Active Alarm
The Walkie-talkie service is a feature that enables two-way communication with your Emergency Contacts. With this service, you, as a User, can immediately communicate with your Emergency Contacts during the entire time an alert is active. This communication method can be used to quickly share information, coordinate assistance, or simply ensure that everyone is safe. It is important to note that this feature is only available to the Emergency Contacts you have designated and the alarm center and only during active alert events, to ensure focused and effective communication.
3.4. Follow Me
With the Follow Me service, you, as a User, can ask your Emergency Contacts to follow you digitally. When the service is activated, your Emergency Contacts can follow your GPS position in real-time. The service remains active until you arrive at your registered home address or until you turn off the service by entering your PIN code.
3.5. Timer Alarm
With the Timer Alarm service, you, as a User, can set a planned route with one or more stops and a pre-set time allocation for each stop. When this service is activated, the app follows your route in real-time and automatically alerts your Emergency Contacts if you deviate from your planned route or if you stay longer than expected at any of the stops.
4. Subscription
SoSafe is a subscription service, and you can choose between four different subscription types:
4.1. SoSafe Starter
With SoSafe Essential, you get access to a SoSafe license and the basic features of the app, i.e., Emergency Contact Alerts, Walkie-talkie – Two-way Communication During an Active Alarm, Follow Me, and Timer Alarm.
4.2. SoSafe Plus
With SoSafe Connect, you get, in addition to the features in the Essential package, a SoSafe button for easily activating an alert without taking out your phone.
4.3. SoSafe Premium
SoSafe Guardian is the subscription for you who, in addition to all the features in the Essential and Connect packages, also want access to the alarm center service.
4.4. SoSafe Family
SoSafe Family Safety is the flexible subscription for you who want to tailor a package for yourself and your family.
5. Price and Payment
The monthly cost for the selected service, including costs related to the alarm center’s work, is specified in the subscription agreement. Payment is made by credit card via the Stripe payment service monthly in advance. If your credit card lacks funds or cannot be charged for any other reason, SoSafe reserves the right to interrupt the User’s access to the service until full payment is made. If payment is delayed by more than 30 days, the User’s SoSafe account, including the user information, such as alert history, stored in the app, will be deleted.
6. Right of Withdrawal
According to the Distance Selling Act (2005:59), you as a consumer have the right to, without giving any particular reason, withdraw your purchase within fourteen (14) days from the conclusion of the agreement. If you wish to exercise your right of withdrawal, you must contact SoSafe’s customer service and clearly state that you wish to withdraw your purchase. You can also fill in SoSafe’s withdrawal form or the standard form from the Swedish Consumer Agency, available at www.konsumentverket.se, and send it to info@sosafe.se. It is the responsibility of the User who has received products (primarily the SoSafe button), manuals, instructions, and packaging from SoSafe to immediately, in connection with exercising the right of withdrawal, return these to SoSafe. Returns should be sent to the address stated on the website. If the Customer does not return the SoSafe button, the Customer will be charged 499 SEK, which corresponds to the cost of the SoSafe button. If the Customer, within the framework of exercising the right of withdrawal, sends back a SoSafe button that is broken or damaged, the Customer is liable for compensation corresponding to (a) the depreciation of the SoSafe button to the extent the Customer has handled the SoSafe button more than necessary to determine its properties or function and (b) a proportional share of the agreed price for the service that SoSafe performed before the customer exercised the right of withdrawal. SoSafe has the right to immediately invoice the Customer an amount corresponding to (a) and (b). The provisions of point 5 regarding payment terms, late payment interest, fee for written payment reminders, collection requirements, and invoice fees also apply to this point 6.

8. Product Warranty
SoSafe guarantees that the SoSafe button meets the technical specifications provided to the Customer in all material respects. The warranty is valid for a period of 2 years from the conclusion of the Agreement.
SoSafe’s warranty does not cover faults arising due to the User, contrary to manuals or other instructions provided by SoSafe, having performed the installation incorrectly or failed in maintenance or handling. The warranty also does not cover faults arising from normal wear and tear or the negligence of the User or a third party. To the extent that the SoSafe button includes software, the warranty does not cover any specific function or result, uninterrupted functionality, absence of viruses, or similar.
9. User Responsibilities, etc.
It is the User’s responsibility to install, maintain, and handle the app and the SoSafe button in accordance with the installation and instruction manuals. The User is also responsible for keeping the app and the SoSafe button updated in accordance with the instructions provided by SoSafe from time to time.
The User is responsible for ensuring that the contact details of the User and the Emergency Contacts are correct and up to date at all times. The User is responsible for ensuring that the internet connection and GPS function are working at all times so that the app can communicate correct information to, among others, the Emergency Contacts and the alarm center.
The User understands that if the User does not fulfill the above obligations, SoSafe cannot be held responsible for any errors, damages, or similar.
10. SoSafe’s Liability and Limitations of Liability
Provided that the User has fulfilled their obligations, SoSafe is liable and shall compensate for damage or loss caused to the User by SoSafe in accordance with what is stated below. SoSafe’s liability only covers damage or loss suffered by the User if the damage or loss is a direct result of SoSafe’s negligence in fulfilling its obligations. SoSafe is never liable for damage in relation to third parties, indirect damage, or other consequential damage.
SoSafe is not liable to the User for any obstacles in the use of the services due to legislation, government decisions, or similar. The presence of such an obstacle does not entitle the User to any compensation or reduction in the User’s payment obligation to SoSafe.
SoSafe is not liable for errors or damage caused by the User using SoSafe’s services or software with a system or software not approved by SoSafe. SoSafe is also not liable for errors or damage caused by computer viruses or similar.
In the event of damage or loss, the User must submit a written claim to SoSafe (complaint) no later than thirty (30) days from the date the User became or should have become aware of the damage or loss. If the User fails to make a complaint within the time limit, the User loses the right to compensation for such damage or loss.
SoSafe’s total liability under the Agreement is limited to an amount equivalent to what the User has paid to SoSafe during the six (6) months preceding the day the damage or loss occurred.
Personal alarm services provide additional protection and do not replace the User’s need to exercise normal caution and obtain the necessary insurance coverage.
In addition to what is expressly stated in this point 10, SoSafe has no liability.
11. Contract Term and Termination
The agreement runs indefinitely, without a binding period, and with a mutual notice period of one (1) month. Termination of the Agreement must be made directly in the app or in writing via email to SoSafe’s customer service to be valid. Termination means that the agreement will not be renewed and the Customer’s right to use the service ceases at the end of the current month. Termination of the agreement also means that the information the Customer uploaded to the service is permanently deleted.
12. SoSafe’s Right to Suspend Users
SoSafe reserves the right to unilaterally decide to suspend Users from the service. Suspension can occur, for example, due to a breach or reasonable suspicion of a breach of these Terms of Service or if the service is used in a way that may cause harm to SoSafe or third parties.
13. Intellectual Property Rights
All intellectual property rights, such as but not limited to trademarks, copyrights, patents, and source code, as well as the functions of the app included in the service, belong to SoSafe and/or its licensors and may not be used by you as a User in any way other than as intended under the Terms of Service or as provided by mandatory law.
As a User, you may not modify, translate, reproduce, copy, or decompile the app, except when this is expressly permitted by law.
14. Assignment of the Agreement, etc.
The Customer may only assign the Agreement with SoSafe’s written consent. SoSafe has the right to assign its rights and obligations under the Agreement, in whole or in part. In the event that claims against the Customer are assigned or pledged by SoSafe, this Agreement is also pledged.
SoSafe has the right to engage subcontractors to fulfill the Agreement, in whole or in part.
15. Force Majeure
SoSafe is exempt from the obligation to fulfill the obligation under the Agreement if the failure to fulfill the obligation is due to a Force Majeure event and the circumstance prevents, significantly hinders, or delays the fulfillment of such an obligation. SoSafe shall, upon the occurrence of a Force Majeure event, immediately notify the User thereof.
A Force Majeure event includes, for example, pandemics, epidemics, exceptional weather conditions, lightning strikes, fires, warlike events, sabotage, labor disputes (e.g., strikes, lockouts, and blockades), disturbances or changes in the public telephone network or public power grid, new or amended legislation or other regulations, government actions or omissions, disturbances regarding the alarm center’s radio traffic between the various units and systems, and other similar circumstances whose effects SoSafe could not reasonably foresee or prevent.
16. Processing of Personal Data
By using SoSafe’s services, the Customer will provide certain personal data to SoSafe for which SoSafe is the data controller. Information on how SoSafe processes the Customer’s personal data is available in our Privacy Policy, which you can find here: https://sosafe.se/privacy-policy.
17. Changes and Additions
SoSafe has the right to unilaterally change the instructions regarding installation, maintenance, and handling. In the event of changes to the mentioned instructions, SoSafe shall notify the Customer thereof.
SoSafe has the right to unilaterally change the Terms of Service. In such a case, SoSafe shall notify the User in writing no later than one (1) month before the change takes effect. If the change entails significant changes regarding the User’s rights and obligations, the User has the right to notify SoSafe within 14 days of receiving the notice from SoSafe that the change is not accepted. In such a case, the Agreement will continue to apply under the previously applicable terms until the Agreement is terminated by either party.
Other changes and additions to the Agreement shall be binding on the Parties only if made in writing and signed (including electronic signatures) by both Parties.
18. Applicable Law and Dispute
Swedish law shall apply to this Agreement. In the event of a dispute, you have the option of turning to the National Board for Consumer Disputes (ARN) or the Swedish general courts.
